{"id":1066,"date":"2017-06-15T06:24:38","date_gmt":"2017-06-15T06:24:38","guid":{"rendered":"https:\/\/renovateme.co.uk\/blog\/?p=1066"},"modified":"2018-09-07T19:23:59","modified_gmt":"2018-09-07T19:23:59","slug":"annual-tax-enveloped-dwellings-ated","status":"publish","type":"post","link":"https:\/\/renovateme.co.uk\/blog\/annual-tax-enveloped-dwellings-ated\/","title":{"rendered":"Annual Tax on Enveloped Dwellings (ATED)"},"content":{"rendered":"<p data-imagelightbox=\"g\"><img loading=\"lazy\" class=\"size-medium wp-image-1073 aligncenter\" src=\"https:\/\/renovateme.co.uk\/blog\/wp-content\/uploads\/ATED-300x251.png\" alt=\"ATED\" width=\"300\" height=\"251\" srcset=\"https:\/\/renovateme.co.uk\/blog\/wp-content\/uploads\/ATED-300x251.png 300w, https:\/\/renovateme.co.uk\/blog\/wp-content\/uploads\/ATED.png 940w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: 'Arial',sans-serif; font-size: 9.5pt;\"><span style=\"color: #000000;\">ATED was introduced in 2013 and is an annual tax payable mainly by companies that own a UK residential property, where the value of the property exceeds the <a href=\"https:\/\/www.gov.uk\/guidance\/annual-tax-on-enveloped-dwellings-the-basics\">minimum threshold<\/a>.\u00a0 Partnerships, where one of the partners is a company, and collective investment schemes are also within the ATED regime.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif; font-size: 9.5pt;\"><span style=\"color: #000000;\">For ATED returns from 1 April 2016 onwards, the minimum threshold is that the property was valued at \u00a3500,000 on 1 April 2012 or at acquisition if later.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif; font-size: 9.5pt;\"><span style=\"color: #000000;\">The amount charged is determined by a banding system, which depends on the value of the property and the applicable year.\u00a0 For the year ended 31 March 2018 the ATED charge is \u00a33,500 for properties valued at more than \u00a3500,000 but less than \u00a31 million and the ATED charge goes through the relevant bands with the maximum charge for this year being \u00a3220,350 for properties worth more than \u00a320 million.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif; font-size: 9.5pt;\"><span style=\"color: #000000;\">A number of reliefs are available, including where a UK residential property is rented on a commercial basis.\u00a0 However, even if a relief applies an ATED return must still be submitted to HMRC and penalties will be charged for ATED returns submitted late.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif; font-size: 9.5pt;\"><span style=\"color: #000000;\">If a UK residential property is sold, which is completely or partly owned by a company then ATED capital gains tax (ATED CGT) will be due, which is at 28%.\u00a0 If the company holding the UK residential property is a non-UK resident company for tax purposes then non-resident capital gains tax (NRCGT) may also be due.\u00a0 If both ATED CGT and NRCGT are applicable then ATED CGT takes precedence, however a NRCGT return would still need to be submitted to HMRC.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Arial',sans-serif; font-size: 9.5pt;\"><span style=\"color: #000000;\">If you need any assistance with relating matters, please email <a href=\"https:\/\/renovateme.co.uk\/expert\/Simon-Johnson\">Simon Johnson<\/a> at <\/span><a href=\"mailto:simon.johnson@kpmg.co.uk\">simon.johnson@kpmg.co.uk<\/a><span style=\"color: #000000;\">.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; ATED was introduced in 2013 and is an annual tax payable mainly by companies that own a UK residential property, where the value of&hellip;<\/p>\n","protected":false},"author":11,"featured_media":1073,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":[],"categories":[172],"tags":[106,73],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v16.8 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Annual Tax on Enveloped Dwellings (ATED) -<\/title>\n<meta name=\"description\" content=\"Do you hold residential property within a limited company?
